Terms and Conditions for Use of the gotobrno.cz Portal

Introductory provisions

These terms and conditions apply to the use of the www.gotobrno.cz Internet portal, including its mobile version as related to the app for mobile phones and tablets (hereinafter referred to as Portal), administered by TIC BRNO, a state-funded institution (hereinafter referred to as Administrator).

These terms and conditions apply to anyone who publishes any textual or visual content through the Portal with the aim of promoting an event and/or place of interest that is not in conflict with the purpose of the Portal (hereinafter referred to as User).

By providing the following personal data (name, surname, address, e-mail address, and phone number) the User gives consent to the Administrator to process the data with the aim of promoting the events and places of interest of the User.

In accordance with the Act on the Protection of Personal Data and on changes of some Acts No. 101/2000 Coll., the Administrator guarantees that the personal data will not be accessed by unauthorized or random people, the data will not be changed, destroyed or lost, transferred or processed in any other way by unauthorized people or misused in any way.

A visitor is a natural or legal person who accesses the Portal through the Internet or mobile network.

User profile refers to an electronic account on the Portal under which the User posts new events into the calendar or edits descriptions of buildings and places of interest. The User is obligated to handle the login data to his/her account in such a way as to prevent its misuse.

Electronic form refers to any form designed to post or edit the content of the Portal (events, buildings, places of interests, etc.).

Posting

The User is responsible for posting truthful content and legally admissible textual or visual templates on the Portal. The User expressly declares to have been given unconditional consent to publish the photos by the people depicted in the photos provided, or by the people depicted in any other way which makes it possible to identify them. These people have also given consent to the User for the Administrator to process all the personal data the User makes accessible through the Portal.

In case the above-stated declaration of the User turns out to be untrue, the Administrator and the User agree on a contractual fine of CZK 50,000. The User shall be obligated to pay this fine based on an invoice issued by the Administrator. This in no way affects the right of the Administrator to claim compensation of damages.

The Administrator reserves the right to put any content posted by the User into the area or category of services or events on the Portal designated by the Administrator for such purpose.

The Administrator has the right to refuse to publish any post in the case that its wording or meaning is in conflict with the purpose of the Portal, violates the ethical principles or interests of the Administrator, is in conflict with valid legal regulations, or disturbs the look of the Portal with its technical/aesthetic quality. The Administrator has the right to refuse any content which in/directly promotes political parties or movements. The Administrator is not obligated to give reasons to the User as to why the content has been refused.

By sending the electronic form or publishing a post through the user profile, the User enters into a contract on publishing a post with the Administrator. The Administrator is obligated to publish a post on the Portal within one day of receiving an electronic order or additional information or references. The time of publishing is based on the request by the User or by the content of the post.

Sources of information and data

The facts, data, and information published on the Portal are based on the data provided by the Administrator and Users. They serve to pass information on to the public, mainly concerning products and services on offer.

In the event that the User posts on the Portal some data – via the electronic form or user profile – that may be protected by copyright, s/he thus automatically grants the Administrator an unlimited (in terms of time and manner), non-exclusive, free-of-charge license to any use of such content in accordance with the Act No. 121/2000 Coll., Copyright Act, as amended. The Administrator is not obligated to make use of such license.

The User hereby commits not to upload any content through the electronic form or user profile to which s/he does not own the copyright, including the authorization to provide the license to the posted content to third parties, and confirms that s/he is aware and accepts full responsibility for any potential violation of the copyright of any third parties. Any claims set up based on these reasons against the Administrator shall be satisfied directly by the User who shall also cover potential damages and lost profits.

In the event that the User violates the responsibility defined in the previous article, the Administrator and User agree on a contractual fine of CZK 50,000 per each violation of this responsibility. The User shall be obligated to pay this fine to the Administrator based on an invoice issued by the Administrator. This in no way affects the right of the Administrator to claim compensation of damages.

The Administrator may change the data posted on the Portal anytime without notifying the User beforehand. Thus, the Administrator is not responsible for any potential damages the Users or visitors may incur in relation to the use of the Portal.

The Administrator is not responsible for the correctness or completeness of the information posted by the Users on the Portal.

Rights and responsibilities of the Administrator

The Administrator is not responsible for the content posted by the Users and reserves the right to remove or not publish posts containing any data with a content or form which could be reasonably considered illegal, racist, disparaging, offensive, or unacceptable in any other way. The Administrator reserves the right to remove any posts with commercial content, links to websites or contact data to commercial subjects in conflict with the purpose of the Portal without any notification.

The Administrator has the right to modify the content of any posts uploaded to the Portal, mainly in case of grammatical errors, incorrect text structure, formatting, and scope, incorrect category placement, etc.

The Administrator has the right to verify the correctness of the data uploaded by the User, but it is not his/her responsibility to do so.

The Administrator is not responsible for the content of other websites of other entities that can be accessed through the Portal.

Common and final provisions

These terms and conditions become valid and come into force on the day they are published at www.gotobrno.cz, i.e. on April 3, 2014, and the Administrator is authorized to change them or add more content to them.
